Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Stately Vows website, services, and AI portrait generation tools (collectively, the "Service") operated by PaintedApp, LLC ("Stately Vows," "we," "us," or "our"). By creating an account, uploading photographs, or generating portraits, you agree to be bound by these Terms.

1. Eligibility & Account

You must be at least 18 years old to use the Service. By registering an account you represent and warrant that you are 18 or older and have full legal capacity to enter into these Terms. You agree to provide accurate registration information and to keep your credentials secure. You are responsible for all activity that occurs under your account.

2. The Service

Stately Vows generates stylized AI portraits from reference photographs you upload. Every portrait is AI-generated: OpenAI's image models paint it, and Anthropic's Claude compares it with your photos to check the likeness. The outputs are machine-generated and are not photographs of you or the persons depicted in your reference photos, and no person paints or retouches them. We do not guarantee any specific likeness, accuracy, or quality of the generated outputs.

Prints and products are made to order by our print partners, Prodigi (prints and canvas) and Printful (apparel, blankets and phone cases), and shipped to the United States, Canada, the United Kingdom, Australia and New Zealand. The companies that handle your data for us are: OpenAI, Anthropic, Stripe, Prodigi, Printful, Resend, Supabase, Vercel. What each one does is listed in our Privacy Policy.

3. Your Representations About Uploaded Photographs

By uploading any photograph to the Service, you represent and warrant that:

1. You have the legal right to upload each photograph, including all necessary copyrights, model releases, and privacy rights.
2. Each photograph depicts only yourself, or persons who have provided you with their express, prior, written consent to submit their likeness to an AI portrait generation service and to receive the resulting AI-generated images.
3. No photograph depicts any individual under the age of 18. If a photograph incidentally contains a minor, you will not submit it; you will crop or remove the minor before upload.
4. Your submission and the resulting AI-generated content do not infringe any copyright, right of publicity, right of privacy, trademark, or other right of any person or entity.
5. You will not use any AI-generated output to impersonate, defame, harass, deceive, harm, sexualize, or create a misleading impression about any third party.
6. You are not a politically exposed person, a head of state, a religious leader, or a public figure uploading photographs of yourself for use in materials that could be misconstrued as official.

You agree to indemnify, defend, and hold harmless Stately Vows, its affiliates, officers, employees, and agents from any claim, demand, loss, liability, damage, or expense (including reasonable attorneys' fees) arising from or related to your breach of these representations or your use of any AI-generated output.

4. License to Reference Photographs

You retain ownership of every photograph you upload. You grant Stately Vows a limited, non-exclusive, royalty-free, worldwide license to process your photographs solely to generate the AI portraits you have requested and to deliver the resulting outputs to you. We do not store your reference photographs on our servers — they are processed transiently and transmitted directly to our AI processing partner to fulfill your request, and are not retained by us after the request completes, as described in our Privacy Policy and Biometric Data Policy. We do not use your photographs to train AI models, sell them to third parties, or use them for any purpose other than fulfilling your portrait generation request.

5. AI-Generated Output

Personal, non-commercial use. Once you have paid for a portrait, you may keep, copy, print, frame, share and give it as a gift for personal, non-commercial purposes, for as long as you like. Commercial use is not included: you may not sell the portrait or products made from it, use it in advertising or to promote a business, or license it to anyone else. Free preview images are watermarked and licensed solely for your evaluation; they may not be reproduced, distributed, or used commercially.

Who owns the portrait. You own the photographs you upload. As between you and us, we hold whatever rights exist in the AI-generated outputs, and we will not sell your portraits or give them to anyone else except the print partner making your order. Images generated by AI with little human authorship may not be protected by copyright at all, so neither of us may be able to stop someone else from copying one. We reserve the right to remove any output that we determine, in our sole discretion, violates these Terms or applicable law.

AI-generated outputs are disclosed as AI-generated through visible labeling on preview downloads (an “AI-Generated · Stately Vows” mark). Removing or altering disclosure labels with the intent to deceive is prohibited.

6. Prohibited Uses

You agree not to use the Service to:

• Create non-consensual intimate imagery of any person
• Create imagery depicting any individual under the age of 18
• Create imagery depicting any identifiable person without their explicit, written consent
• Create imagery of public figures, celebrities, politicians, or deceased persons
• Upload a photograph you do not have the right to use, such as a professional photographer's image you have not licensed
• Ask for logos, brand names, film or television characters, or anyone else's trademark in a portrait
• Create misleading or deceptive content intended to impersonate any person
• Create content that infringes any copyright, trademark, or other intellectual property right
• Create content that violates any applicable law or regulation
• Attempt to reverse-engineer, scrape, or circumvent any technical limitations of the Service

7. DMCA Notice & Takedown

We respect intellectual property rights. To submit a notice of claimed copyright infringement under the Digital Millennium Copyright Act, send the required information to our copyright contact below:

Your notice must include: identification of the work allegedly infringed; identification of the material claimed to be infringing; your contact information; a statement of good-faith belief that the use is unauthorized; a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the rightsholder; and your physical or electronic signature.

Stately Vows will terminate the accounts of users determined, in our sole discretion, to be repeat infringers.

8. Payment & Refunds

Each customer receives 4 free passes (one pass is four watermarked preview portraits of one style); additional passes are sold 10 for $10. Purchased passes, prints, downloads, and merchandise are charged at the prices shown at checkout, processed through Stripe. Because each portrait and product is made to order for you, all sales are final and there are no returns for a change of mind. If a print or product arrives damaged, defective or misprinted, or an order is not delivered, we will replace it or refund it: our Refunds & Returns page says how. Nothing in these Terms limits a right you have under consumer protection law.

9. Service Availability

We provide the Service on an "as is" and "as available" basis. We do not guarantee uninterrupted operation, error-free outputs, or specific generation times. We reserve the right to modify, suspend, or discontinue the Service at any time. We may, in our sole discretion, decline to generate any portrait we determine violates these Terms or applicable law.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, STATELY VOWS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. AI-GENERATED OUTPUTS ARE PROVIDED "AS IS"; WE DO NOT WARRANT THAT THEY WILL MATCH YOUR EXPECTATIONS OR ANY SPECIFIC LIKENESS.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, STATELY VOWS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

12. Termination

You may terminate your account at any time by signing in, opening your account, and requesting deletion, or by emailing us. We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or applicable law, or for any other reason in our sole discretion. Upon termination, the licenses you granted us continue solely for the limited purpose of data retention required by law and our orderly wind-down of any pending orders.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised effective date and version. For material changes, we will notify registered users by email or in-product notice. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

14. Governing Law & Disputes

These Terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Multnomah County, Oregon, and you consent to personal jurisdiction in those courts.
